Un-enforcable Contracts
It is embarrassing the amount of homemade half-baked un-enforceable contracts people write and sign. Contracts are what governs and establish rights in a legal relationship. Un-enforceable contacts are usually to the benefit of the weaker party but not always. This gives the employee or the tenant or the smaller business more power. Depending on how a contract is written, the whole thing can be void if only one part of it is unenforceable.
When a contract or provisions within are un-enforceable than the rights governing that relationship for both parties will often be assumed as the common law rights. In Employment law this means the employee can have more vacation time, longer duration for termination notice and more. If a new replacement contract is signed without consideration than that may also be void.
